Terms and Conditions

SERVICE
All bookings are subject to confirmation of receipt of your deposit. No Session date will be secured until the deposit has been paid. Any remaining balance will be due before you receive any images. Online photo galleries will be ready for viewing within 4 weeks of your session date. All products must be paid in full before they are released to the client. 

PRICES
Prices are subject to change without notice. The Photographer will honour the prices as they stand on the day the Client pays their deposit. 

CANCELLATION
If the Photographer is forced to cancel the agreement then the deposit will be reimbursed in full to the Client or rearrange for a mutually agreeable date. Clients are able to reschedule bookings once due to illness or other unforeseeable circumstances, provided at least 12 hours notice is given. In the event that less notice is given or in the event that the Client does not inform the Photographer of their inability to attend their session, the deposit will be forfeited.

FORCE MAJEURE 
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

DISPLAY 
Marina Feldman Photography may display any photographs included in this contract in the photographer’s studio, website, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows. The Client can choose to opt out in their booking form. For the avoidance of doubt, all copyright in the photographs remains with Marina Feldman Photography.

ARCHIVING OF PHOTOGRAPHS
Once payment has been received and photographs delivered, the Photographer shall not be liable for any future storage of the Client's photographs. The Photographer will use reasonable endeavour to keep the Client's images for a period of 12 months from the session date. Photographs can be deleted after the contract is completed at the written request of the Client.

WEATHER
For sessions taking place at an outside location there may be a requirement to rearrange the date should the weather be unsuitable. Marina Feldman Photography will provide an alternative date in these circumstances.

DIGITAL FILES 
Digital files remain the property of the Photographer however digital copies which may be supplied by the Photographer come with licence for the owner to reproduce images digitally or in print for personal (not commercial) use. For commercial use, please contact the Photographer for a separate quote. The sale of digital product is final, in accordance with the Consumer Rights Act 2015. 

PRINTS AND PRODUCTS
The Photographer cannot guarantee the quality of prints, frames and other products ordered by the Client via third party providers.  

GIFT VOUCHERS AND PRINT CREDIT
Gift vouchers are valid for a period of 12 months from the date of issue of the voucher. Print Credit must be used at the time of placing your order for digital files. Any other credit towards another session must be used within 12 months of the payment for the order triggering the right to further session credit.

COMPLAINTS
In the unlikely event of any complaint, this should be raised by the Client with the Photographer, in writing, within 7 days of first becoming aware of the matter and in any event within 14 days of receipt of the images.

PRIVACY POLICY
The privacy of our clients is very important to us.

Any data collected, including, but not limited to, your names, email addresses and mailing address are used solely in the provision of photographic services, are never shared with any third parties.

When you enquire, whether by email or phone, we may ask for your name, email address, due date, child date of birth or wedding date and venue.

Your right to access and be forgotten: You are able to request, on demand, all data Marina Feldman Photography, as a business, holds on you. You also have the right to withdraw your consent to have your data stored at any time. Please email info@marinafeldmanphotography.co.uk requesting this.

The type of personal information we collect 

We currently collect and process the following information:

your name

and, if relevant, your due date, date of birth of your child, wedding date and venue.

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

- We collect your information for the purpose of communicating, marketing and selling relevant goods and/or services to you. The legal basis for this processing is consent, namely taking steps, at your request, to provide information about our availability and services and the performance of our obligations under our contract to provide photography services. 
- We collect information about how you use our website, our social media and other online services. The legal basis for this is our legitimate interest to properly administer our business.
- We do not collect information that is not reasonably necessary for the purpose of providing our photography services. We do not collect personal data unless we are required to by law, or under the terms of the contract between us. 
- We will only use your personal data for a purpose it was collected for or a reasonably compatible purpose if necessary. In case we need to use your details for an unrelated new purpose we will let you know and explain the legal grounds for processing.
- We may process your personal data without your knowledge or consent where this is required or permitted by law. Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

How we store your personal information 

We will only retain your personal data, such as name, email, phone number, for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

For tax purposes, the law requires us to keep basic information about our customers for six years after they stop being customers. This information is stored in our accounting software, which is GDPR compliant. 

All personal data may be anonymised and used for research or statistical purposes without the need to further notify you.

Photographs we take for you are not stored with your personal data. We will aim to retain archive images for up to the full length of the statutory copyright period or longer, in order that we may be able to prove our legal rights. 

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information. 

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
